The Intellectual Property Department was invited by the Secretariat of the Pharmaceutical Association of Malaysia (PhAMA), to give a talk on patents and competition law in the context of the pharmaceutical industry. More than 25 attendees from various PhAMA member companies participated in the Forum, comprising individuals involved in regulatory affairs, and legal & compliance. The team from Shearn comprised Karen Abraham, Timothy Siaw, Jyeshta Mahendran, Zaraihan Shaari, Michelle Loi, Ameet Kaur, Mike Ho, Elisia Engku Kangon and Pravind Chandra.

  • Current IP Issues & Peculiarities of IP Protection for Pharmaceutical Inventions, by Zaraihan Shaari
  • Updates on Medical Use Claims, Doctrine of Equivalents, and Government Use Licences, by Timothy Siaw
  • Update on Patent Cases, by Michelle Loi
  • Interaction between IP Rights and Competition Law, by Jyeshta Mahendran

The Forum was very interactive, with many of the questions raised revolving around the current patents landscape in Malaysia, and the relationship between IP and anti-competition practices. Our team also had the opportunity to engage with the attendees more closely during the refreshment breaks, and get a better understanding of the industry’s current view on IP rights.
